Terms of Service

By creating an Onyx Checkout account or using the service you agree to these Terms. Onyx Checkout is a checkout layer for online stores: we replace the checkout page of your store with one you control, and your buyers pay through a payment account opened in your own name. We are not a payment processor and we never hold your funds.
1.Who you are contracting with
“Onyx Checkout”, “we” and “us” mean Horizon International LLC, registered at 1209 Mountain Road PL NE #5605, Albuquerque, NM 87110, United States, contactable at support@onyxcheckout.com. “Merchant”, “you” means the person or company that accepted these Terms.
If you accept on behalf of a company, you confirm you may bind that company. If you do not agree, do not use the service.
2.What the service does
Onyx Checkout provides:
- A hosted checkout page, served on a subdomain you control, that you design yourself.
- A script installed on your store theme that sends buyers to that page.
- Order bumps, post-purchase offers, shipping options, discount codes and payment links.
- Server-side conversion tracking to the advertising platforms you connect.
- Creation of the paid order in your own store admin after payment succeeds.

3.Accounts you must open yourself
The service requires two accounts that belong to you and not to us: an application created inside your own store platform account, and a payments company opened in your name with our payment partner. You are responsible for the accuracy of the information you give them, for completing their identity checks, and for complying with their terms.
We access those accounts only through the credentials you provide, and only to operate the service. You can revoke that access at any time; the checkout stops working when you do.
4.Fees, billing and cancellation
- Plans are billed per store, monthly in advance, at the price shown when you subscribe.
- Prices are exclusive of VAT and other applicable taxes, which are added at payment.
- We take no percentage of your sales. What your payment provider charges to process a payment is separate and is set by them.
- You may cancel at any time. The checkout keeps working until the end of the period you have paid for, and is then switched off. Paid periods are not refunded pro rata.
- If a renewal payment fails we may retry it. If it keeps failing, the store is paused: your configuration is kept and the checkout stops taking orders.
- We will give at least 30 days’ notice by email before changing the price of a plan.
5.Your responsibilities
- You are the seller of everything sold through your checkout. Product descriptions, pricing, taxes, delivery, returns, warranties and customer service are yours.
- You must publish and honour your own refund, shipping and privacy policies, and comply with consumer law where your buyers are.
- You are responsible for obtaining any consent required for the tracking you enable, on your storefront and at checkout.
- You must not use the service for anything unlawful, for goods your payment provider prohibits, or in a way that damages the service or other merchants.
6.Store platform rules
Your store platform’s own terms continue to apply to your store, and they — not us — decide what is permitted there. You are responsible for reviewing those terms and for deciding whether routing your checkout away from the platform’s own page is acceptable under them. We do not indemnify you for decisions your store platform takes about your account.
7.Availability and support
We aim to keep the service available at all times but do not promise uninterrupted operation. We may take it down for maintenance, and will avoid peak selling periods where we can. Support is provided by email at support@onyxcheckout.com and through the guides in the product.
8.Your data and ours
You keep ownership of your store data, your customer data and everything you configure. We process personal data on your behalf under the Data Processing Agreement, which forms part of these Terms. Our own handling of your account data is described in the Privacy Policy.
We keep aggregate, non-identifying statistics about how the service is used to operate and improve it.
9.Suspension and termination
You may stop at any time by cancelling your plan and removing the script from your theme: your store’s original checkout returns immediately. We may suspend or terminate an account that breaches these Terms, that is used unlawfully, or where a payment provider or store platform requires it. Where we can, we will tell you first.
After termination we keep your configuration for 30 days so it can be restored, then delete it. Order records may be kept longer where the law requires.
10.Warranties and liability
The service is provided “as is”. To the extent permitted by law we exclude implied warranties, and we are not liable for lost profits, lost sales, lost data or indirect damages. Our total liability in any twelve-month period is limited to the fees you paid us in that period.

11.Changes to these Terms
We may update these Terms. Material changes are announced by email or in the product at least 30 days before they take effect. Continuing to use the service after that date means you accept the new version.
12.Governing law
These Terms are governed by the laws of New Mexico, United States, and disputes are subject to the exclusive jurisdiction of the state and federal courts located in Bernalillo County, New Mexico. Nothing here removes rights that consumer law gives you and cannot be waived.
